1. General provisions

1.1 This data privacy policy (hereinafter referred to as the Privacy Policy) applies to all personal data that you provide to us, or that we collect and process, when you use the services provided by the modern art space Nemuno7 (hereinafter referred to as the Producer). The space itself is produced by the VšĮ Ars futuri.

The Producer respects your privacy and protects the personal data you provide to us and that we collect, as set out in this Privacy Policy. This Privacy Policy explains why your personal data is collected and how it is used.

2. Processing of personal data

2.1 Newsletter

On the website www.nemuno7.lt you can find the Newsletter subscription section. If you would like to receive the newsletter, you can enter your email address in this section.

The basis for the collection and processing of the visitor’s personal data for the purpose of direct marketing is your consent to receive newsletters.

2.2 Events, rentals

When registering for or organising events, educational activities or renting Nemuno7 premises, the Producer may ask visitors or renters to provide their names, preferred dates and times, number of participants, email addresses, addresses, telephone numbers. In the case of rentals, the following data shall be collected: name of the event, type of event, scenario of the event, information about the client, duration of the event, number of hours needed for preparation and clean-up after the event, equipment used, contacts.

Your personal data will be processed for the purposes of the Producer’s administration, statistics, security, feedback and the protection of the assets owned by the Producer. In the case of events, your data is processed on the basis of consent, and in the case of renting premises managed by the Producer, on the basis of a rental agreement (for the purpose of concluding and executing the agreement).

In the case of a lease agreement, the data will be kept for 10 years after the end of the agreement, and in the case of events for 1 year.

2.3 Video surveillance

Video surveillance of Nemuno7 premises and its accesses shall be carried out by the Producer in order to ensure the security of the property managed by the Producer, the protection of the life, health, property, other rights and freedoms of the Producer’s employees, visitors and other persons, where other means or measures are insufficient and/or inappropriate for the purposes set out above, and where the interests of the data subjects in the surveillance field are not overriding.

Video surveillance is carried out in the dredger area (on the deck).

Video surveillance shall not be carried out in parts of the premises managed by the Producer where there is a reasonable expectation of absolute privacy and where such surveillance would be degrading to human dignity (e.g., in the toilet).

The Producer shall ensure that the processing of video data is carried out only by persons authorised by the Producer, who have been informed of the legislation on the legal protection of personal data and who have signed an undertaking to comply with it. Before entering the premises managed by the Producer where video surveillance is carried out, information about the video surveillance shall be clearly and appropriately displayed.

Your personal data shall be retained for 14 days from the moment the video is recorded.

2.4 Filming and photography during events

Filming and photography are carried out for presentation, promotional and administrative purposes by the Producer.

The Producer is the controller of the personal data (videos or photographs) collected during the events or exhibitions, and may transfer the videos to third parties who organise the event and carry out advertising and presentation material. Such persons may include producers and distributors of promotional material, database software providers, database and website administration service providers, etc.

Videos and/or photographs and excerpts thereof taken during the event may be published and broadcasted live on Nemuno7 Facebook and Instagram accounts, website, as well as other advertising or information dissemination media.

Photographs and videos of events are taken on the basis of our legitimate interest in recording events taking place on the premises owned by the Producer and to use this material for presentation, promotional and administrative purposes.

Photographs and videos are retained for 5 years from the time they are taken.

2.5 Data retention period

We process and store all of your personal data that we collect by the means set out above for no longer than is necessary for the purposes set out in this Privacy Policy.

We will retain and process your personal data (email) for direct marketing purposes for 3 years from the date of the last newsletter opening. You can unsubscribe at any time by clicking on the “Unsubscribe” button at the bottom of every newsletter we send you. You can also request to unsubscribe by emailing info@nemuno7.lt

In the cases provided for in this Privacy Policy, other retention periods for personal data are established.

2.6 Transfer of data

The controller of your personal data will be VšĮ Ars futuri (Šv. Gertrūdos 51-23 LT-44283 Kaunas). Your personal data will not be disclosed to any persons other than the Producer’s partners, without whom the services described in this Privacy Policy cannot be provided smoothly. Your personal data may also be disclosed to government or law enforcement agencies, such as the police or regulatory authorities, but only upon their request and only when required by applicable law or to protect our rights or the safety of our visitors, employees and resources.

2.7 Data protection

Data processing is subject to the security and processing requirements set out in the Law on Legal Protection of Personal Data of the Republic of Lithuania and the General Data Protection Regulation of the European Union.

2.8 Your rights

You have the following rights in relation to your personal data:

1) to request that the Producer access and rectify or delete the data or restrict the processing of the data;
2) the right to object to the processing of the data;
3) the right to receive your personal data in a structured, commonly used and computer-readable format (right to data portability);
4) the right to withdraw consent;
5) the right to lodge a complaint with the State Data Protection Inspectorate.

2.9 Validity and amendments

This Privacy Policy is effective from 14 January 2022. The latest version of this Privacy Policy is available at www.nemuno7.lt. Changes and/or additions to the Privacy Policy shall come into force after their publication on the website.
